Nym Node Terms & Conditions

1. Mere Conduit

We neither initiate the transmission of data passing through our node, nor do we select the recipient of such data, nor select or modify the information transmitted. The operator of this NYM node does not act as a hosting provider, content provider, platform operator, or publisher. The operator of this NYM exit node acts exclusively as a mere conduit within the meaning of § 13 Austrian E-Commerce Act (E-Commerce-Gesetz, ECG) and applicable European Union law.

2. No-Logs Policy

The operator of this node adheres to a strict no-log policy. No records pertaining to user activity, traffic content, connection metadata, or any other data passing through this node are created, stored, or retained. By technical design, the architecture of this node makes it impossible to capture, reconstruct, or derive any meaningful information from the transmitted data, ensuring that no personally identifiable or traceable information can be collected under any circumstances.

While this node does not log or store identifiable user data, the operator will:

- Respond to legally binding requests from law enforcement or regulatory authorities, as required by applicable law.

- Provide available information to address abuse complaints or legal obligations.

This cooperation is limited to information that can be provided without violating the node's no-logs policy or compromising privacy-preserving design.

The operator is a non-profit association under Austrian Vereinsrecht (Vereinsgesetz 2002) and does not operate this node for commercial hosting or content distribution purposes.

No servers, hosting equipment, or other operational infrastructure are located at the associations registered address. The operator does not maintain, create, or retain any additional records, logs, or other information that could be used to identify users, map server locations, or otherwise be of material relevance to law enforcement or other authorities.

4. Scope and Relationship to NymVPN Terms

These Terms govern the operation of this specific node and the relationship between the node operator and any party whose data transits through this infrastructure. These Terms are separate from, and complementary to, the NymVPN Terms of Use, which govern the relationship between Nym Technologies S.A. and users of the NymVPN application.

Key Distinction: If you are using NymVPN or other Nym mixnet applications, you remain subject to Nym Technologies S.A.'s Terms of Use. However, when your traffic passes through this node, it is also subject to these Node Terms. Both sets of terms apply concurrently but govern different legal relationships.

5. Prohibited Uses

Use of this node is strictly subject to compliance with all applicable laws and regulations. By routing traffic through this node, users acknowledge and accept these terms under Austrian and European law. Any use of this node for illegal activities is strictly prohibited, including but not limited to:

The publication or distribution of false information that constitutes a criminal or administrative offense.

Sending unsolicited messages or spam to other users.

Unauthorized use, uploading, downloading, or distribution of copyrighted, trademarked, or otherwise protected content.

Supporting or participating in actions that are contemptuous of human dignity.

Publishing offensive, racist, discriminatory, or pornographic content toward other users or the public.

Any other activity that violates national or international laws, regulations, or rights of third parties.

Note: These prohibited uses align with and supplement the prohibited activities outlined in the NymVPN Terms of Use. Users of NymVPN must comply with both sets of restrictions.

Upon receiving a complaint or detecting a violation of these terms, the node operator may take actions such as blocking, suspending, or otherwise restricting access to the service, to the extent technically feasible and in accordance with applicable law and the Nym Operator Terms & Conditions. The operator will act in good faith to address misuse while maintaining the network's privacy-preserving design.

6. Operational Responsibilities and Legal Framework

Node Operator Responsibilities: The node operator (onchainaustria — Verein zur Förderung von Forschung, Bildung und Entwicklung von Technologie) is solely responsible for:

- The operation, maintenance, and technical management of this node infrastructure.

- Compliance with these Node Terms and applicable Austrian and European law.

- Responding to abuse complaints and legal requests directed at this specific node.

- Implementing technical measures to address misuse while preserving the network's privacy architecture.

Nym Technologies S.A. Responsibilities: Nym Technologies S.A. is solely responsible for:

- The NymVPN application, client software, and user-facing services.

- User account management, subscriptions, and customer support for NymVPN users.

- The Terms of Use governing the relationship between Nym Technologies S.A. and its users.

- Software development, maintenance, and technical support for the NymVPN application.

Legal Liability Framework: The node operator functions as a "mere conduit" under applicable law and does not automatically assume legal liability for the content of traffic passing through this node. Liability is limited to the extent required by applicable Austrian and European law. This node operates independently within the Nym network, and the node operator's responsibilities are distinct from those of Nym Technologies S.A.

7. Liability and Disclaimer

The node operator provides this service on an "as-is" basis and does not assume any liability for any direct, indirect, incidental, or consequential damages resulting from the use, misuse, or inability to use this node. The operator does not guarantee uninterrupted or error-free operation and is not responsible for the content transmitted through the node by users.

By using this node, users acknowledge and accept that the operator cannot monitor, control, or be held liable for the nature, legality, or security of any data passing through the network. Users are solely responsible for their activities and compliance with applicable laws.

8. Abuse

That being said, if you still have a complaint about the router, you may email the maintainer. If complaints are related to a particular service that is being abused, the maintainer will submit that to the NYM Operators Community in order to add it to the Exit Policy referenced below. The community governance can only blacklist entire IP:port destinations across the entire network.

This node operates under the laws of Austria and Europe. Any disputes arising from the use of this service shall be subjectto the exclusive jurisdiction of the competent courts in Austria, insofar as legally permissible.

12. Blocking Instructions

Services that wish to block traffic from Nym exit nodes may do so by referencing the published list of exit IP addresses. The Nym project provides a network explorer to fetch IP:port combinations. Blocking should be applied carefully to avoid unnecessary disruption of legitimate traffic.

13. Transparency & Updates

The operator may publish transparency reports or community updates regarding node operation and abuse handling. These Terms & Conditions are subject to periodic revision.
